Nutzungsbedingungen
1. Anbieter und Geltungsbereich
Die App nearme wird angeboten von Akira Karimkhani, Sonnenallee 170A, 12059 Berlin, Deutschland, E-Mail: nearme@go-touch-grass.com („wir“). Diese Bedingungen gelten für die Nutzung der App. Mit der Registrierung stimmst du ihnen zu. Die Nutzung ist kostenlos.
2. Dein Account
- Du musst mindestens 16 Jahre alt sein.
- Gib eine E-Mail-Adresse an, die dir gehört, und halte dein Passwort geheim.
- Ein Account pro Person. Gib dich nicht als jemand anderes aus, auch nicht als Betreiber eines Ortes.
- Benutzernamen dürfen nicht beleidigend sein oder Rechte anderer verletzen.
3. Null Toleranz für anstößige Inhalte und Missbrauch
Bei nearme gilt null Toleranz. Wer gegen diese Regeln verstößt, wird ohne Vorwarnung gesperrt. Das gilt für Notes, Kommentare, Fotos, Chat-Nachrichten, Benutzernamen, Bubbles und Angaben zu Places.
Verboten sind insbesondere:
- Hass, Hetze und Diskriminierung, z. B. wegen Herkunft, Religion, Geschlecht, sexueller Orientierung oder Behinderung,
- Belästigung, Mobbing, Drohungen und Einschüchterung,
- sexuelle Inhalte und Nacktheit, jede Sexualisierung von Minderjährigen,
- Gewaltdarstellung und -verherrlichung, Aufrufe zu Gewalt oder Selbstverletzung,
- verfassungsfeindliche Symbole und Inhalte sowie alles andere, was gegen Gesetze verstößt,
- persönliche Daten anderer ohne deren Einverständnis, etwa Adressen, Telefonnummern oder Fotos,
- andere zu verfolgen oder ihren Standort ohne Zustimmung zu verbreiten,
- Spam, Werbung ohne unsere Zustimmung, Betrug und Fake-Accounts,
- Inhalte, an denen du keine Rechte hast.
4. Melden, Blockieren und Moderation
- Du kannst Nutzer, Notes, Kommentare, Places und Bubbles in der App melden und Nutzer blockieren. Blockierte Nutzer sehen dich nicht mehr und können dir nicht mehr schreiben.
- Wir prüfen Meldungen in der Regel innerhalb von 24 Stunden. Inhalte, die gegen diese Bedingungen verstoßen, entfernen wir und sperren die verantwortlichen Accounts.
- Texte werden beim Speichern automatisch auf unzulässige Wörter geprüft und gegebenenfalls abgelehnt.
- Wir dürfen Inhalte und Accounts auch ohne Meldung entfernen oder sperren, wenn ein Verstoß vorliegt.
5. Places, Betreiber und Mods
- Wer einen Ort tatsächlich betreibt, kann den zugehörigen Place in der App beantragen. Wir prüfen jeden Antrag von Hand und können Nachweise verlangen. Falsche Angaben führen zur Sperre.
- Betreiber und von ihnen ernannte Mods können Inhalte an ihrem Place anpinnen und entfernen. Sie müssen sich dabei an diese Bedingungen halten.
- Wir können Betreiber- und Mod-Rechte jederzeit entziehen. Löscht ein Betreiber seinen Account, wird der Place wieder frei.
6. Deine Inhalte
Deine Inhalte bleiben deine. Du räumst uns das einfache, unentgeltliche Recht ein, sie in der App zu speichern und anderen Nutzern anzuzeigen, solange sie nicht gelöscht sind. Du bist dafür verantwortlich, dass du die nötigen Rechte an deinen Inhalten hast, insbesondere an Fotos und an abgebildeten Personen.
7. Sicherheit
nearme zeigt Inhalte und Menschen in deiner Nähe. Sei vorsichtig, welche Informationen du teilst, und triff dich mit Leuten, die du über die App kennenlernst, nur an öffentlichen Orten. Du kannst deine Sichtbarkeit in den Einstellungen jederzeit ausschalten.
8. Verfügbarkeit und Änderungen der App
Wir bemühen uns um einen stabilen Betrieb, können aber keine ständige Verfügbarkeit zusagen. Wir dürfen Funktionen ändern, erweitern oder einstellen.
9. Haftung
Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, für Schäden aus der Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Im Übrigen ist unsere Haftung ausgeschlossen, da die App unentgeltlich bereitgestellt wird. Für Inhalte anderer Nutzer sind wir nicht verantwortlich, entfernen rechtswidrige Inhalte aber, sobald wir davon erfahren.
10. Kündigung und Löschung
Du kannst deinen Account jederzeit in der App unter Profil → Einstellungen → Account löschen entfernen. Dabei werden deine Daten gelöscht. Wir können deinen Account bei Verstößen gegen diese Bedingungen sperren oder löschen.
11. Änderungen dieser Bedingungen
Wenn wir diese Bedingungen ändern, informieren wir dich in der App und bitten dich erneut um Zustimmung. Ohne Zustimmung kannst du die App nicht weiter nutzen, deinen Account aber jederzeit löschen.
12. Schlussbestimmungen
Es gilt deutsches Recht. Zwingende Verbraucherschutzvorschriften des Staates, in dem du deinen gewöhnlichen Aufenthalt hast, bleiben unberührt. Für die Verarbeitung deiner Daten gilt unsere Datenschutzerklärung.

1. Provider and scope
The nearme app is provided by Akira Karimkhani, Sonnenallee 170A, 12059 Berlin, Germany, email: nearme@go-touch-grass.com ("we"). These terms apply to your use of the app. By signing up you agree to them. The app is free of charge.
2. Your account
- You must be at least 16 years old.
- Use an email address that belongs to you and keep your password secret.
- One account per person. Do not impersonate anyone else, including the operator of a place.
- Usernames must not be offensive or infringe the rights of others.
3. Zero tolerance for objectionable content and abuse
nearme has zero tolerance. Anyone who breaks these rules will be banned without warning. This applies to notes, comments, photos, chat messages, usernames, bubbles and place details.
In particular, the following is prohibited:
- hate speech and discrimination, e.g. based on origin, religion, gender, sexual orientation or disability,
- harassment, bullying, threats and intimidation,
- sexual content and nudity, any sexualisation of minors,
- depicting or glorifying violence, calls for violence or self-harm,
- anti-constitutional symbols and content, and anything else that breaks the law,
- other people's personal data without their consent, such as addresses, phone numbers or photos,
- stalking others or sharing their location without consent,
- spam, advertising without our consent, fraud and fake accounts,
- content you do not hold the rights to.
4. Reporting, blocking and moderation
- You can report users, notes, comments, places and bubbles in the app and block users. Blocked users no longer see you and can no longer message you.
- We usually review reports within 24 hours. We remove content that violates these terms and ban the accounts responsible.
- Texts are automatically checked for prohibited words when saved and rejected if necessary.
- We may remove content and ban accounts without a report if there is a violation.
5. Places, operators and mods
- If you actually operate a location, you can claim the corresponding place in the app. We review every claim manually and may ask for proof. False claims lead to a ban.
- Operators and the mods they appoint can pin and remove content at their place. They must follow these terms when doing so.
- We can revoke operator and mod rights at any time. If an operator deletes their account, the place becomes available again.
6. Your content
Your content remains yours. You grant us the simple, free right to store it in the app and show it to other users for as long as it is not deleted. You are responsible for holding the necessary rights to your content, in particular to photos and to the people shown in them.
7. Safety
nearme shows content and people near you. Be careful about what you share, and only meet people you get to know through the app in public places. You can turn off your visibility in the settings at any time.
8. Availability and changes to the app
We aim for stable operation but cannot guarantee constant availability. We may change, extend or discontinue features.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. Otherwise our liability is excluded, as the app is provided free of charge. We are not responsible for other users' content, but we remove unlawful content as soon as we become aware of it.
10. Termination and deletion
You can delete your account at any time in the app under Profile → Settings → Delete account. This deletes your data. We may ban or delete your account if you violate these terms.
11. Changes to these terms
If we change these terms, we will let you know in the app and ask for your consent again. Without consent you cannot continue to use the app, but you can delete your account at any time.
12. Final provisions
German law applies. Mandatory consumer protection rules of the country where you habitually reside remain unaffected. Our privacy policy applies to the processing of your data.
