Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
6. Deine Rechte
Du hast das Recht auf
- Auskunft über deine gespeicherten Daten (Art. 15 DSGVO),
- Berichtigung (Art. 16 DSGVO),
- Löschung (Art. 17 DSGVO),
- Einschränkung der Verarbeitung (Art. 18 DSGVO),

Privacy policy
This is a translation for convenience. In case of doubt, the German version above prevails.
This privacy policy applies to the website and to the nearme app.

2. Visiting this website (hosting)
This website is served via Cloudflare (Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA). When you visit it, Cloudflare processes technically necessary data, in particular your IP address, the date and time of access, the page requested and browser and device information. This is needed to deliver the website and to protect it against attacks.
The legal basis is our legitimate interest in secure and stable operation (Art. 6(1)(f) GDPR). We have a data processing agreement with Cloudflare. Cloudflare is certified under the EU-US Data Privacy Framework, which ensures an adequate level of data protection for transfers to the USA.
We do not use cookies, tracking or analytics tools.
3. The nearme app
The app shows notes, places and people near you. To do this we process the following data. Unless stated otherwise, the legal basis is the performance of the user agreement (Art. 6(1)(b) GDPR). Our terms of use apply. The app is intended for people aged 16 and over.
Account. Email address, password (stored only in encrypted form), username, optionally a profile picture, and the version and time of your consent to the terms of use.
Location. Only if you allow it and only while you use the app. We use your precise position to show the map, notes and people near you and to check whether you are close enough to a place to leave a note there. Only your latest position is stored. It is overwritten with every update and removed when you sign out or delete your account. Other users only see you if "Visible to others" is turned on, only rounded to about 100 m and only if you were active in the last 15 minutes. Without location access you can still explore places using the search.
Your content and activity. Notes, comments, photos, chat messages, bubbles, place details, votes, friendships, mentions and which notes you have read. Notes, comments and places are visible to other users, content in bubbles to their members, chat messages only to the participants. The data is kept until you delete it, it expires or you delete your account.
On-device image recognition. To suggest a name for a new place, the app analyses the chosen photo with Apple's Vision framework directly on your device. No data is sent to us or to third parties for this.
Maps and place search. Maps, addresses and nearby places come from Apple Maps (Apple Distribution International Ltd., Ireland). Apple receives the map area or the coordinates searched, but no data about your nearme account. Apple's privacy policy applies.
Moderation and safety. When you report something, we store the report, the reason and who reported it. We also store whom you block, account bans and claims for a place together with the proof provided. Texts are automatically checked for prohibited words when saved. This serves to protect users and to enforce the terms of use (Art. 6(1)(b) and (f) GDPR). We delete reports once they are no longer needed for moderation.
Storage location. All app data is stored with Supabase (see section 4), on servers in the EU (Frankfurt am Main), under a data processing agreement.
On your device. The app stores your sign-in (in the iOS keychain) and settings such as visibility and design locally. The app contains no tracking, no advertising and no analytics tools. Data is not sold and not shared for advertising.
Deleting your account. In the app under Profile → Settings → Delete account. This immediately deletes your profile, notes, comments, chats, photos, location and roles. Places you operate become available again. The data disappears from technical backups as soon as these are overwritten in the regular cycle.
App Store and TestFlight. Apple is responsible for downloads, updates and beta testing. Apple's privacy policy applies.
4. Signing up for the beta waitlist
When you sign up for the beta, we store your email address and the time of sign-up. We use it only to send you an invitation to beta-test our app via Apple TestFlight and to let you know when the beta starts. No newsletter, no sharing for advertising.
The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time without giving reasons by emailing nearme@go-touch-grass.com, and we will delete your address.
The addresses are stored with Supabase (Supabase, Inc., 970 Toa Payoh North #07-04, Singapore 318992), with whom we have a data processing agreement. The data is stored on servers in the EU (Frankfurt am Main).
To invite you, we pass your email address to Apple (Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland), which sends the TestFlight invitation. Apple's privacy policy applies to the use of TestFlight.
We delete your email address once the beta phase has ended, or earlier if you withdraw your consent.
5. Contacting us by email
If you write to us, we process your details to answer your request (Art. 6(1)(b) or (f) GDPR). Messages are forwarded to our inbox via Cloudflare Email Routing. We delete them once they are no longer needed and no statutory retention obligations apply.
6. Your rights
You have the right to
- access the data stored about you (Art. 15 GDPR),
- rectification (Art. 16 GDPR),
- erasure (Art. 17 GDPR),
- restriction of processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- object to processing based on legitimate interests (Art. 21 GDPR),
- withdraw your consent with effect for the future (Art. 7(3) GDPR).
Just send us an email. You can also lodge a complaint with a data protection supervisory authority, for example the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit), Alt-Moabit 59–61, 10555 Berlin, Germany.
